These Terms govern your access to and use of Shadow Peak Boxing (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old and legally able to enter a contract. By using the Service you confirm that you are physically fit enough to participate in combat-sports fitness training, or that you have obtained clearance from a qualified physician.
2. Account
You are responsible for activity under your account and for keeping your credentials secure. Notify us immediately of unauthorized use.
3. Acceptable Use
- No reverse engineering, scraping, or unauthorized access
- No re-distribution of workouts, videos, or other content
- No harassment, hate speech, or illegal activity in community features
- No use of the Service to train others commercially without a license from us
4. Subscriptions and Purchases
Subscriptions renew automatically until cancelled. You may cancel any time from your account; cancellation takes effect at the end of the current billing period. Physical merchandise is sold through Shopify and subject to our Refund & Shipping policy.
5. Content
All workouts, videos, branding, and software are owned by Shadow Peak or its licensors and protected by copyright. We grant you a personal, non-transferable, revocable license to use the Service for personal, non-commercial training.
You retain ownership of content you submit (community posts, photos). You grant us a worldwide, royalty-free license to host, display, and distribute that content within the Service.
6. Assumption of Risk
Combat sports and high-intensity training carry inherent risk of injury, including serious injury or death. You voluntarily assume all such risks. See our Medical Disclaimer.
7. Disclaimers
The Service is provided "AS IS" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by law, Shadow Peak's total liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim or (b) USD $100. We are not liable for indirect, incidental, consequential, or punitive damages.
9. Termination
We may suspend or terminate your account for violation of these Terms. You may delete your account at any time from your profile settings.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Delaware, except where applicable consumer law provides otherwise.
11. Changes
We may update these Terms. Material changes will be notified by email or in-app. Continued use after the effective date constitutes acceptance.
